One of my all-time favorite activities is catching inconsistencies in testimony or an opposing argument. One of my first depositions was a case of accused insurance fraud. I will never forget that the witness insisted that all of the equipment for the business went up with the fire. However, when presented with the expert evidence that there were no traces of the equipment from the fire, I asked how they thought this was possible. They confessed they “may have moved some of the equipment prior to the fire.” When pressed as to where it was moved, they conceded it was moved to their basement, where it still resided.
